The families of two men who died and of another who was left with permanent brain damage from a traffic accident sued the Chinese company that made the car’s tires and the New Jersey company that distributed them. The car the men three were in reportedly swerved out of control and rolled over when a tire they were using blew out. The lawsuit argued that the Chinese manufacturer “deliberately and secretly” took out a safety layer of rubber between the steel belts on the tire.
The New Jersey importer of the tires filed suit in the case, arguing that the Chinese company that made the tires should be fully liable. However, the plaintiff families argued that the distributor should have inspected the tires and should back up the products they are selling.
New Jersey Tire Failures
Tire failures on New Jersey’s streets and highways are among the most dangerous problems that can occur while driving. Tire failures often lead to cars swerving out of control, flipping over and hitting other traffic or buildings. More tragically, such incidents often lead to severe injuries, lost work time and future medical payments that many people cannot afford.
Some unscrupulous companies try to cut costs on the products they design and build by cutting back on safety features on those products. Other times car manufacturers don’t install tires on the cars in as safe a manner as possible. There are several reasons for tire failures in New Jersey:
Making the connection between a tire failure and a vehicle accident is perhaps the easy part of investigating tire issues. Many times it is quite obvious to law enforcement officials investigating the scenes of wrecks that a tire going flat or flying off a car is the root cause. The difficult part of investigating tire failures is determining why the tire failed and who is responsible.
A qualified New Jersey product liability attorney can establish the link between a failing tire and the person who is negligent. This can require a great deal of research and time, and an attorney who has a success rate with product liability cases can handle the load. A reputable New Jersey product liability lawyer can sift through the paperwork and establish the link needed to prove a case and get results.
